SUMMARY OF THE NEW POINTS OF THE DOCTORAL DISSERTATION
As an in-depth study on the domestication of international treaties in building and
perfecting the legal system from the perspective of general theory of the state and law, the
dissertation contributes to legal science a number of new issues as follows:
Firstly, the dissertation has linked the theoretical contents of the domestication of
international treaties with the knowledge system, the theory of the legal system, of the
construction and improvement of the legal system which is widely recognized in legal
science.
Secondly, the dissertation clarifies the necessity and characteristics of the domestication
of international treaties in building and perfecting the national legal system.
Third, the dissertation builds a theoretical framework on the principles, subjects,
contents, forms, and methods of domesticating international treaties in building and
perfecting the national legal system and using them for reflecting the practice in Vietnam.
Fourthly, the dissertation proves that in Vietnam today, the activity of domesticating
international treaties is closely related to the activities of law-making, the requirements for
the domestication of international treaties have a reciprocal impact with the requirement of
perfecting the legal system, the results of the domestication of international treaties affect
the quality of the legal system.
Fifthly, the dissertation clarifies the role of the domestication of international treaties in
building and perfecting the legal system through the actual impacts of this activity on the
constitutive elements of the Vietnamese legal system. At the same time, the dissertation
explains the opposite effects of elements of the Vietnamese legal system on the
domestication of international treaties.
Sixthly, on the basis of identifying appropriate guiding and scientific viewpoints, the
dissertation proposes a number of specific solutions and recommendations to further
promote the domestication of international treaties to meet the requirements of building and
perfecting the legal system in Vietnam in current situation.
