In the context of an increasingly developing global economy and fierce competition,
business ethics has become an important factor that not only affects the reputation and brand of
businesses but is also closely related to the success of businesses, and the sustainable
development of society. However, in Vietnam, as the market economy becomes more and more
deeply integrated, businesses face many challenges and opportunities to assert their position,
and business ethics is still a fairly new issue. In addition, the awareness of business ethics in
Vietnam is currently not unified and complete, which leads to violations of business ethics in
individuals and businesses at different levels, requiring timely attention and resolution from relevant parties.
The boiler explosion at Binh Minh Wood Company, which seriously injured and killed the
company's employees, has raised serious ethical concerns related to the business's operations
and compliance with regulatory requirements, safety regulations, and general concern for
employee welfare. To fully understand this issue, we will analyze various ethical theories to
help explain and evaluate the actions and related consequences of this incident. Additionally,
we will delve into the individual and organizational moral judgments that shaped the decisions
that led to the explosion. Finally, potential solutions and alternative approaches will be
suggested to address these ethical lapses and prevent similar occurrences in the future, to
promote a more equitable environment, safer, and more ethically responsible business. II.
Overview of the business ethics issue in Binh Minh Wood Company 2.1. Stakeholder 2.1.1. Internal stakeholder
Director of Binh Minh Wood Company: Feng Yong is the person who directs the boiler
installation and manages all activities of Binh Minh Wood Company. However, when this boiler
expired, he still did not replace the machine, which was the direct cause of the accident. In
addition, during the process of purchasing and installing the furnace, he did not register and
underwent strict inspection by the Department of Labor, War Invalids and Social Affairs.
Therefore, Mr. Feng Yong's behavior shows signs of the crime of "violation of labor safety
regulations", stipulated in Article 295 of the Penal Code. Not only that, in terms of morality,

Machinery supplier: Binh Minh Wood Manufacturing Company said that during use, the
company discovered a technical problem and contacted the equipment supplier to check,
maintain, and repair on April 30 (the time the boiler had expired). On the morning of May 1
(only 1 day after maintenance), when company staff came in to check and operate the machine,
an accident occurred. This shows that the machinery supplier may be responsible and explain
before the law why just one day after the supplier did maintenance, the boiler exploded. Or why
did we not detect an expired boiler during maintenance inspection and ask the company to
replace it? This is a matter of the supplier's work expertise as well as the ethical aspect, they
must be held responsible for the carelessness that contributed to the accident, causing loss of life.

2022, the Department of Labor, War Invalids and Social Affairs of Vinh Cuu district inspected

until now, the authorities have not checked compliance with labor safety regulations once," said

others. The explosion also caused smoke, dust, and debris to shoot out, but fortunately, it did
not cause damage to people. If people feel unsafe around their living area, they should notify
the authorities for timely inspection and fire prevention. 2.2. Ethical issues 2.2.1. Individual
Mr. Feng Yong's behavior violates basic ethical principles such as responsibility, integrity,
and respect for people. His use of a boiler beyond its expiration date demonstrated his lack of
responsibility for worker safety and his placing profits above human life.
Mr. Yong also violated labor safety. The manager is responsible for ensuring a safe working
environment for employees, but he ignored this. 2.2.2. Corporate
Binh Minh Wood Company is also responsible for this accident. The company did not take
the necessary safety measures to protect its employees. If the company (the board of directors,
not just Mr. Yong) had established a set of regulations on labor safety as well as a plan for strict
supervision and inspection of labor safety, it probably would not have been possible for such a
problem to occur. Therefore, ethical responsibility may belong to the regulations on labor safety
supervision of the enterprise, not just Mr. Yong personally. 2.3. Ethical dilemmas
Firstly, Mr. Yong may be in a dilemma. He knew there was a problem but did not conduct
an inspection on time, leading to a fatal accident. The decision to ignore safety and not replace
a new boiler or to replace a new and costly boiler can lead to ethical dilemmas. In this situation,

do maintenance for them or not do maintenance, ask them to replace the machine, and possibly
lose customers. The supplier continued to choose maintenance for them instead of advising
them to replace the device with a new one. And this also directly caused the explosion on May
1, after only 1 day of maintenance.
Finally, if Binh Minh company's technical staff knows the boiler has a problem but is still
required to operate it, Binh Minh's technicians also face an ethical dilemma. Complying with

The relevant theories of issue in Binh Minh Wood Company 3.1. Utilitarianism
Utilitarianism lies in the theories of normative ethics, and it dictates that the appropriate
course of action should have beneficial effects on the masses and maximize happiness.
Specifically, utilitarianism holds that the morally right course of action in any situation is the
one that, when compared with all other possible actions, will produce the greatest balance of
benefits over costs for everyone affected. This approach is sometimes referred to as a
consequentialist approach to ethics because it focuses on whether the consequences of our actions are good or bad.
In this case, the decision by Binh Minh Wood Production and Trading Company not to
inspect the equipment may save short-term costs but lead to severe consequences for human
lives and property. Overall, the losses in lives, health, and labor safety far outweigh the
shortterm benefits the company might achieve. Furthermore, the accident caused immense pain
and loss to many people, reducing the overall happiness of the community and society. This
contradicts the fundamental principle of utilitarianism, which is to maximize happiness and minimize suffering.
In this case, it can be seen that the company used a boiler and air compressor whose safety

worker safety has led to disastrous consequences. This is a lack of awareness about labor safety
in businesses. Besides, we can also see the lack of management responsibility, the company's
Board of Directors has been lax in management, lacking inspection and supervision of
compliance with labor safety regulations. Binh Minh Wood Production and Trading Company's
decision not to inspect equipment may save immediate costs but lead to severe consequences
in terms of human life and property. This action has left severe consequences in terms of not
only human life and property but also caused much suffering for many people. In general, the
losses in terms of life, health, and labor safety far outweigh the short-term benefits that the company can achieve.
On the individual side, some workers may not be fully equipped with knowledge and skills
about labor safety, leading to unsafe behaviors during work.
In this case, the optimal action may be compliance with occupational safety regulations
and periodic equipment inspections to ensure that all workers are protected and the risk of
accidents is minimized, which will help prevent explosions from occurring, minimize damage
to people and property, and bring benefits to the majority of people. 3.2. Rights and Duties
Right ethics are ethics that are most important to human rights. According to the right ethics
theory, human rights are the ultimate appeal and they should be respected. Human rights are
entirely different from legal rights. A few examples of human rights are freedom of speech,
freedom of expression, and right to privacy. Specifically, Right ethics in engineering are given
paramount importance to the safety, health, and welfare of the public.
Duties Ethics of Immanuel Kant: Immanuel Kant is one of the most renowned ethicists
regarding duties. He argued that all duties stem from one fundamental duty: to respect human
beings. Respecting human beings means respecting their autonomy, and all other rights fall
under this. Kant also stated that duty ethics are universal and apply equally to everyone without
discrimination. Kant has three main ideas about duty ethics:
- Universality: Duty ethics apply to all rational individuals.
- Categorical Imperative: The rules that determine what is right originate from the set
of duties, as it is the correct way to act.
- Absolute: These rules have no exceptions. However, many ethicists oppose this idea

have their lives and health protected when participating in the production process. This includes
the right to work in a safe environment and to be assured that the equipment and machinery

Company also have an obligation to ensure that every worker is working in a safe environment

The concept of care is inherent to professions that care for individuals and this approach to
ethics has therefore been a central part of professional ethical issues in both nursing and medical
ethics, but in fact has much broader applications in relation to science and technology. For
example, "due care" in engineering highlights the importance of maintenance and repair of
systems, reflecting the principles of the ethics of care.
In this case, the "ethics of care" theory requires the managers and directors of Binh Minh
Wood Company to pay special attention to the safety and welfare of workers. This includes
implementing full enough measures to maintain and inspect systems such as boilers, to ensure
they operate safely and do not pose a danger to workers. However, in reality, the company and
its leaders did not Prioritize responsibility and care for their workers. They do not ensure that

In-depth Analysis of Business Ethics
Applying Moral Reasoning to the Bình Minh Wood Company Boiler Explosion Case 4.1. Moral Standards
The relevant moral standards in this case include:
Duty to Care: Under the duty of care, businesses have a responsibility to take reasonable
measures to ensure the safety of workers and the public. In this case, Binh Minh Wood
Company failed to comply with its duty of care by using boilers and air compressors whose
safety inspection has expired: This is a serious violation of labor safety. By continuing to
operate boilers and compressors past their due date, the company placed its workers in danger.

and responsible for their actions. In this case, Binh Minh Wood Company violated the principle
of using boilers and air compressors that have expired their inspection, which is a sign of a lack

a technical problem and contacted the equipment supplier to check, maintain, and repair on
April 30. On the morning of May 1, when the company's technical staff came in to check and
operate, the boiler exploded, causing a particularly serious occupational accident.
Based on the documents and evidence collected, the Police Investigation Agency of Dong
Nai Province determined that the above Company's boiler has expired its safety inspection from
November 26, 2022; the air compressor has expired its technical safety inspection from January
5, 2024. The cause of the explosion was because the boiler and air compressor had expired
safety inspection but the Company did not re-inspect according to regulations and still put it
into operation and production.
Binh Minh Wood Company is said to have lacked appropriate risk prevention measures.
For example, the company does not have a process for periodically checking and maintaining
equipment, nor does it have a troubleshooting plan when dangerous situations occur. The
Department of Labor, War Invalids and Social Affairs said that this company has not registered
to use labor safety equipment for the boiler and also does not have boiler inspection documents.
Meanwhile, according to the law, the boiler is one of the devices that must undergo strict labor
safety inspection and must be registered with the Department of Labor, War Invalids and Social
Affairs where the company operates. After receiving approval from the department, the
company can put the boiler into operation for production.

accepted responsibility for the incident, provided fair compensation to those affected, and
implemented significant safety improvements to prevent future occurrences, it indicates a lack
of remorse and a disregard for the safety of its employees and potentially the surrounding community.
Therefore, applying the moral reasoning framework to the Bình Minh Wood Company
boiler explosion case reveals several ethical concerns:
- Negligence: The company may have been negligent in maintaining the boiler

Solutions and Alternative Approaches
5.1. Solutions after an accident occurs
To overcome the consequences of the boiler explosion in Dong Nai, specific measures need
to be implemented for relevant parties including companies, employees, suppliers, local
management organizations, and people around businesses at risk of fire, explosion, and accidents.
For the company: The company needs to overcome physical damage, quickly repair and
replace damaged equipment caused by the explosion, and upgrade safety systems to prevent
similar accidents in the future. future. At the same time, re-evaluate and improve safety
processes: Review and improve production and labor safety processes, ensuring strict
compliance with labor safety standards and regulations. Closely coordinate with the authorities
