1.Khái niệm giám định thương mại?
Theo quy định tại Điều 254 LTM 2005, giám định thương mại là
hoạt động thương mại do một thương nhân thực hiện những công việc cần
thiết để xác định tình trạng thực tế của hàng hóa, kết quả cung ứng dịch vụ
và những nội dung khác theo yêu cầu của khách hàng. Về bản chất, giám
định là một quá trình mà bên giám định sử dụng năng lực chuyên môn,
phương tiện kỹ thuật và sự hiểu biết của mình để kiểm tra, quan sát hàng
hóa, dịch vụ hay hoạt động sản xuất theo yêu cầu của khách hàng để cung
cấp thông tin theo yêu cầu của khách hàng.
